By agreeing to these terms, I acknowledge and certify that:

Prior Express Written Consent (PEWC): I will only send marketing text messages to individuals who have provided clear, affirmative written consent to receive automated marketing messages from my company specifically. I understand that consent must be obtained before any marketing message is sent and that retroactive consent is not valid.
Opt-Out Compliance: I will immediately honor all opt-out requests. I understand that PLAY automatically processes STOP, QUIT, END, CANCEL, and UNSUBSCRIBE keywords, and that I must also honor opt-out requests received through any other channel (email, phone, in-person).
Sending Hours: I understand that marketing messages may only be sent between 8:00 AM and 8:00 PM in the recipient's local time zone, and that PLAY enforces this restriction at the platform level.
Prohibited Content: I will not use PLAY to send messages related to sex, hate, alcohol (without age-gating), firearms, tobacco, or cannabis (S.H.A.F.T. content). I understand that violations may result in suspension of my account and the entire PLAY platform.
List Imports: When importing phone numbers, I certify the source of consent and will provide proof of capture. I understand that importing numbers without TCPA-compliant consent is a direct violation of federal law.
Indemnification: I agree to indemnify PLAY against any claims, fines, or damages arising from my non-compliant use of the platform, including TCPA violations which carry statutory damages of $500–$1,500 per message.
Message Content: Every marketing message I send will identify my company by name and include opt-out instructions. I will not use misleading content, fake urgency, or false scarcity claims.

This agreement is governed by the Telephone Consumer Protection Act (TCPA), FCC regulations, CTIA guidelines, and applicable state laws. PLAY reserves the right to suspend any account that violates these terms. Agreement version 1.0.
